TOU/Piracy question

A small mommy board that I'm part of is doing a silent auction to raise money to help board members in need (natural disasters, divorce, etc).

Several people requested that we auction off a couple of hybrid scrapbooks. But I'm wondering how this will work with TOU without using commercial items.

Can the person creating the album buy the kit and use it for the album that's being auctioned off? The person "buying" the kit is not paying the person creating the album, as their donation is being made to the board.

How does this work? I consider myself to be pretty informed on this stuff, but this one has me stumped.

BTW - missed you all! I've been on vaca, and just returned.
 
Not sure on this one sweetie, but I'm sure one of our fabulous designers will come and answer your question.
 
My interpretation is that it would fall under Scrap 4 Hire and whichever designers allowed that would probably be ok with it. Or since it's charity they wouldn't mind either way.

But, of course, I'm not in the position to say, since I'm not everyone.

I could definitely donate some kits to the cause, though!
 
I think every designer will feel differently about this one. If it was me, it would be 100% OK **as long as** 100% of the proceeds were going to charity. SSD has a S4O/S4H friendly TOU, so this generally would fall under being OK anyhow with OUR kits, but designers outside SSD, you'd have to check with them each individually to ask. Still, the safest thing to do is ask any designers that you would like to use their work, kwim.
 
I was pretty much going to type exactly what Bree said, but she said it way better than I could have. LOL!

I'd totally be fine with my products being used for this type of use.
 
yeah- I am with Ang- that to me falls under S4H and since you are giving out the actual digital kit its not at all in piracy violations. Just double check with the designers- I am sure they would be more than happy to allow this kind of use
